MOBILE TEXT TERMS OF USE
These Mobile Text Terms of Use (“Mobile TOU”) govern your use of the text messaging
information and marketing program (the “Program”) provided by Las Palapas. (the
“Company”). Please read this Mobile TOU carefully. By opting into the Program, you agree to this Mobile TOU, the Company’s online PRIVACY POLICY and the Company’s overall TERMS OF USE, as amended from time to time (collectively, the “Terms”). Before opting into the Program, please read the Terms carefully. Your access to, and use of, the Program represents your agreement to these Mobile TOU. IF YOU DO NOT AGREE WITH THESE TERMS, INCLUDING CHANGES THERETO, DO NOT ACCESS, SUBSCRIBE OR USE THE
PROGRAM.
The Company’s Program is an account information and marketing program that sends its users updates on account activity, as well as, but not limited to, great deals and special offers. This information is delivered directly to their mobile phones, via SMS and/or MMS. As a Program member, you may receive order updates, special deals, insider news, access to in-store events (where applicable), among other brand-specific communications.
Mobile Messaging Terms:
When you opt into our service with your mobile number, you are expressly agreeing that the Company may send text messages (including SMS and MMS) to that phone number. You also agree to pay the charges to your wireless bill or to have them deducted from your prepaid balance for this service. You acknowledge that you are sixteen years of age or older and you have the consent of the wireless account holder. The Company may send recurring auto marketing mobile messages per month. The number of Account Updates & Information messages you receive will depend on your activity with the brand. If you signed up by texting a signup keyword, you will receive a confirmation text message, and you may need to reply as instructed to complete registration. Message and data rates apply. If you opt-out, you agree to receive a final text message confirming your opt-out. You may opt out at any time by texting the word STOP to 70602. - You agree to indemnify us against any claims, demands, actions liabilities, costs or damages arising out of your use of the Service including any material that you access or make available using the Service, or violation of the agreement, including but not limited to use of the Service by you (or permitted by you) involving offensive or illegal material or activities that constitute copyright infringement. - Please bear in mind that our wifi service is free. The Las Palapas Public network is free for as long as the building is open. We do not guarantee the availability or speed of our wifi service nor are we responsible for slow response times, the non-availability of any web site nor any other issue that interferes with your use of our wifi service.
- We are not under any obligation to you to provide our wifi service nor are we liable to you (or any third party) in any way if our wifi service is not available for use.
- We may terminate provision of our wifi service without notice and at our discretion.
- Use of our wifi service is entirely at your own risk and we will not accept any liability for any loss of any kind.
- We cannot guarantee that our wifi facility will be compatible with any device or hardware.
- We are not responsible for your device’s or hardware’s inability to use or access our wifi service caused by the state of your device or hardware.
- You acknowledge that our wifi network is sometimes unsecured and information sent over the network may be visible to others.
- We cannot be held responsible for the privacy or security of your activities. It is strongly recommended that you use a personal firewall and take due care when transmitting confidential information such as credit card details over the Internet. - It is your responsibility to provide antivirus and malware protection for your device or hardware. We will not accept any liability for damage to your device or hardware through you using inadequate security settings or your failure to protect your device by using appropriate software, nor are we responsible for any viruses or spyware which may be downloaded on to your device while using our wifi service.
- We assume no responsibility for the safety of your device or for laptop configurations, security, or data files resulting from connection to our wifi service.
- We cannot provide technical assistance to you in relation to using our wifi service.
- To minimize access to inappropriate material we may block certain web sites and chat rooms using filtering software. This software, however, may not always prevent access to such material and we are not responsible if any unsuitable sites have not been blocked.
- We monitor use of our wifi service, including web sites visited.

The wifi service is filtered but this is not always effective in blocking unsuitable material. You must take responsibility for your own use of the service and your own activities.
- You must not send e-mails or messages, post blogs, publish or download content or carry out any other activity through our wifi service in any way which is offensive, racist, discriminatory, obscene, promotes violence or public disorder, is intended to deceive, infringes copyright or other intellectual property rights, breaches confidential information, privacy or any other rights or is done with any criminal or terrorist intent.
- You must not use our wifi service to send spam emails or other unsolicited advertising or promotional materials.

You will indemnify us and any organization managing and/or supporting our wifi service against all losses, damage, expenses (including reasonable legal costs and expenses), liabilities or claims arising out of you breaking any of the terms and conditions of use of our wifi service.
